Overview

Special Business District, to be known as the "Soulard Special Business District" (hereinafter referred to as the "District"), ishereby established for the area of the City depicted in Exhibit "A", attached hereto and incorporated herein, and described as follows:

Beginning at the intersection of the centerlines of U.S. Interstate 55 and Park Avenue; thence eastwardly along the centerline of Park Avenue across all intervening streets to the intersection of the centerlines of Park Avenue and Miller Avenue; thence southeastwardly along the center line of Miller Avenue across all intervening streets to the intersection of the center line of Miller Avenue and the Mississippi River; thence southwardly along the Mississippi River across all intervening streets to the intersection of the Mississippi River and the centerline of Barton Street as extended to the Mississippi River; thence westwardly along the extended centerline and centerline of Barton Street across all intervening streets to the intersection of the center lines of Barton Street and 7th Street; thence southwardly along the centerline of 7th Street across all intervening streets to the intersection of the center lines of 7th Street and Victor Street; thence westwardly along the centerline of Victor Street across all intervening streets to the intersection of the centerlines of Victor Street and 11th Street; thence southwardly along the centerline of 11th Street across all intervening streets to the intersection of the centerlines of 11th Street and Sidney Street; thence westwardly along the centerline of Sidney Street across all intervening streets to the intersection of the centerlines of Sidney Street and U.S. Interstate 55; thence northwardly along the centerline of U.S. Interstate 55 across all intervening streets to the intersection of the centerlines of U.S. Interstate 55 and Park Avenue.

Seven (7) members appointed by the Mayor with the advice and consent of the Board of Aldermen; five (5) shall own real property within the district and two (2) members shall be renters within the district.

All persons appointed or reappointed shall be nominated only by a written petition to the Mayor signed by at least ten (10) registered voters residing in the district.

Board Duties and Purpose

For the purposes of paying costs and expenses to be incurred in the acquisition, construction, improvement, expansion and/or maintenance of any facilities of the District, the District may incur indebtedness and issue notes for the payment thereof under the terms of, and subject to, the requirements set forth by law.

Member Requirements

Appointments require Board of Aldermen approval.

There shall be a Board of Commissioners to administer the District. The Board of Commissioners shall be selected as follows:
The Board of Commissioner shall consist of seven (7) members appointed by the Mayor with the advice and consent of the Board of Aldermen; five (5) shall own real property within the district and two (2) members shall be renters within the district.

No fewer than three (3) members shall be registered voters and owner-occupants of residential real property used a detached single family residence, condo or a building of 4 dwelling units or less within the district;

No fewer than one (1) shall own commercial real property within the district;

One (1) member shall rent, occupy and be a voter registered from real property used as a dwelling unit within the District,

No employee or elected official of the City shall be a member;

All persons appointed or reappointed shall be nominated only by a written petition to the Mayor signed by at least ten (10) registered voters residing in the district. Such petition shall contain:

a. nominee's name and

b. residential address and telephone number, and

c. occupation and title, if any, and

d. business address and telephone number, if any, and

e. a list of all real property owned within the District, if any, and

f. the category of membership the nominee is seeking, and

g. the printed name, address and signature of each registered voter nominating the person.

The Mayor shall not appoint any person not qualified under the provisions of this section.

Term of office:

Each member of the Board of Commissioners shall serve for a four (4) year term (except as provided herein with respect to the initial members), with terms expiring as of December 31st of the designated year or when their successors are appointed as provided herein, whichever is later.

Initial Members and Terms:

The initial members shall be appointed for the terms set forth as follows: one (1) member shall be appointed for a term expiring December 31, 1994; two (2) members shall be appointed for a term expiring December 31, 1995; two (2) members shall be appointed for a term expiring December 31, 1996; and two (2) members shall be appointed for a term expiring December 31, 1997. The initial members shall be appointed and confirmed no later than September 30, 1994.

Removal:

The Mayor with approval of the Board of Aldermen may remove any member of the Board of Commissioners for misconduct or neglect of duty upon written charges and after a public hearing.

Vacancies:

Vacancies on the Board of Commissioners, occasioned by removal, resignation, expiration of term, or otherwise, shall be reported in writing to the Mayor by the Board of Commissioners.

The Board of Commissioners shall publish or cause to be published notice of each vacancy on the Board of Commissioners on at least one (1) occasion in at least one (1) newspaper of general circulation no later than two (2) weeks after such report is provided to the Mayor. The vacancy shall be filled in like manner as an original appointment no later than thirty (30) days after the date of said report to the Mayor and no sooner than seven (7) days after the publication of notice of such vacancy.

Appointments to fill vacancies shall be for the unexpired portion of a term only.
