Details about the Cherokee Street Community Improvement District

Overview

A community improvement district, to be known as the “Cherokee Street Community Improvement District” (hereinafter referred to as the “District”), is hereby established pursuant to the CID Act to provide services and improvements, impose sales and use taxes and special assessments, and carry out other functions as set forth in the Petition, which is attached hereto as Appendix A and incorporated herein by this reference.

The District boundaries are set forth in the map and district legal descriptions included in the Petition in Appendix A.

Thirteen (13) directors appointed by the Mayor with the consent of the Board of Aldermen.

Successor Directors, whether to serve a new term or to fill a vacancy on the board, shall be appointed by the Mayor with the consent of the Board of Aldermen by resolution according to the slate submitted to the City Register by the Board.

Authorizing Legislation

Board Duties and Purpose

The District is authorized by the Petition, in accordance with the CID Act, to impose a sales and use tax at a rate not to exceed one percent (1%) on retail sales within the District and to levy a special assessment on real property located within the District to provide funds to accomplish any power, duty or purpose of the District.

Member Requirements

Appointments require Board of Aldermen approval.

The Petition provides that the District shall be governed by a Board of Directors consisting of thirteen (13) individual directors (collectively the “Directors” and each a “Director”), such Directors to be appointed by the Mayor of the City with the consent of the Board of Aldermen, in accordance with the CID Act.

Qualifications:

Each member of he board ("Director") shall meet the following requirements:

a. be at least 18 years of age;

b. be and must declare to be either an owner or an authorized representative of an owner of real property within the District ("Owner"), an owner of a business operating within the District ("Operator"), or a registered voter residing within the District ("Renter"), as provided in the Act; and

c. be nominated pursuant to a slate submitted by the Board to the mayor of the City (the "Mayor"), with the consent of the Board of Aldermen.

Board Representation:

In order to ensure fair representation of the district, the board representation shall meet the following requirements:

a. at least two (2) Directors shall be owners;

b. at least two (2) Directors shall be operators;

c. at least two (2) Directors shall be residents; and

d. at least two (2) Directors shall be operators or resident that ARE NOT owners (each, a "Tenant").

The initial Directors shall serve for the term set out opposite their names or until their successor is appointed in accordance with this petition and their successors shall serve for 4-years or until their successor is appointed accordance with this petition. In the event for any reason a Director is not able to serve his or her full term any vacancy to the Board shall be filled by appointed in the same manner as successor Directors.

Successor Directors:

Successor Directors, whether to serve a new term or to fill a vacancy on the board, shall be appointed by the Mayor with the consent of the Board of Aldermen by resolution according to the slate submitted to the City Register by the Board. Upon receipt of such slate from the board, the City Register shall immediately deliver the slate to the Mayor and the Board of Aldermen. Not later than 30 days following the date of the slate is submitted to the City Register.
