Amending the Lead Poisoning Law
This ordinance amends the Lead Poisoning Control Law for the City of St. Louis by requiring certain building permits issue only following an inspection of lead hazards and certification that hazards will be addressed by qualified contractors and workers. These requirements will ensure hazardous lead conditions are effectively abated by contractors observing high standards for the safety of occupants and tenants, workers, and the surrounding community. Under current law, certain lead abatement projects require prior notice to the state. This Ordinance enacts penalties against lead abatement contractors who fail to comply with notification requirements under Missouri State law, and other notification requirements as set out in this ordinance. Contractors failing to provide initial notice under State law and this City Ordinance will be subject to a stop work order, suspension of City work permits on the instant work site, and a fine. Work may recommence upon payment of fine, compliance with notice requirements and the Building Commissioner’s satisfaction the contractor has complied with other permitting conditions. Lead abatement contractors who persistently fail to provide notification under State and City law shall forfeit their privilege of conducting lead abatement projects in the City of St. Louis. The Building Commissioner and City of St. Louis Lead Inspection and Hazard Control Division shall receive complaints regarding violations of this ordinance and accordingly conduct investigations, including through periodic inspections of lead abatement projects to determine on-site compliance with federal, state, and local regulations, permits, and project notifications submitted to the building Commissioner.

Amending the Zoning Code of the City of St. Louis
This bill amends the Zoning Code of the City of St. Louis to comport with Amendment Three to the Missouri Constitution providing for the lawful sale of marijuana to adults subject to the conditions therein; adding definitions to the same including Comprehensive Facility, Comprehensive Marijuana Cultivation Facility, Comprehensive Marijuana Dispensary Facility, Comprehensive Marijuana-Infused Products Manufacturing Facility, Consumer, Marijuana Accessories, Marijuana Facility, Marijuana Microbusiness Facility, Microbusiness Wholesale Facility, Marijuana Testing Facility, and Preroll; and amending the Use Table of Section 26.70.030; and containing a Severability Clause and an Emergency Clause.
This bill will have the positive effect of incorporating new lawful uses into the Zoning Code as allowed by Missouri Constitution.

The bill appropriates the funds to the Affordable Housing Commission (“AHC”) and authorizes the AHC to expend such funds for the purposes of supporting affordable housing preservation, maintenance, and residential services within the current boundaries of the 17th ward and neighborhoods located North of Delmar Boulevard. This bill will fund housing assistance to homeowners who represent vulnerable populations within the city (senior citizens, low income, and people with disabilities). General Obligation Public Improvement Bonds
This Board Bill seeks to authorize submission to qualified electors a proposal for the issuance of up to fifty million ($50,000,000) of general obligation public improvement bonds. Utilizing the current property tax levy, there will be no tax increase. With an election due to be scheduled for a redistricting ballot measure in April 2022 there are no additional costs associated with this bill.
If approved, funds raised from the subsequent issuance would be available to use for the following purposes: (1) resurfacing arterial streets and bridges, (2) design and construction of a Public Safety Answering Point (PSAP) a new state-of-the-art Emergency Operations Center combining Police, Fire, EMS, CEMA, and Citizen Service Bureau (3) design and construction of pedestrian and bicycle transportation facilities, (4) maintaining the safety and security of the jails and improving public safety (5) providing match share funds, where applicable and necessary, to utilize funds made available under the American Recuse Plan Act of 2021 and the Infrastructure Investment and Jobs Act of 2021 in furtherance of any of the cited projects herein and, (6) replacing, improving, renovating and maintaining buildings, bridges, and equipment of the City of St. Louis including neighborhood recreation centers and fire houses, and (7) for expenses associated with the issuance of the bonds.
The City’s backlog of unmet infrastructure needs greatly exceed the amount of federal assistance expected by the City in the near future. These funds will enhance the City’s ability to provide matching grant funds to apply for competitive grants and offer the opportunity to begin design work in advance of future federal assistance and secure materials in an effort to mitigate project delays due to supply chain issues.

Department of Human Services (“DHS”) Grant
The purpose of this bill is to authorize the City of St. Louis, by and through the Department of Human Services (“DHS”), to accept a grant award from Washington University, Health Communication Research Laboratory, in the amount of $30,000.00 to cover expenses incurred in the Calling Older adult/disabled Participants to Ensure access to vaccines (COPE) program. DHS, through its St. Louis Area Agency on Aging (SLAAA) division, currently provides Home Delivered Meals to over 2,000 clients. Through COPE, each client will be called to ask about the services they receive, ask if they have been vaccinated, and if not, they will be asked if they would like to be added to the homebound vaccination program. COPE will assist recipients of the Home Delivered Meals with access to vaccines through the homebound vaccination program, providing transportation to vaccine clinics, or following-up with clients regarding vaccine questions. COPE will assist Washington University to fulfill agreements with the National Institutes of Health in getting people connected with the vaccine.

Electric Vehicles for Senior Services Grant
The purpose of this bill is to authorize the City of St. Louis, by and through the Division of Human Services (“DHS”), accept a grant award from FORTH in the amount $60,000.00 to cover transportation costs and expenses serving senior citizens in St. Louis through contracting the use of electric vehicles with Northside Senior Center and City Seniors Center from 2021 to 2023. Bill will assist FORTH in fulfilling contractual requirements under its United States Dept. of Energy (DOE) funded project.
This bill authorizes the Director of DHS to accept and approve the appropriation to expend grant funds for the purposes and uses to assist with supporting the use of Electric Vehicles to deliver meals and provide transportation services to senior citizens in St. Louis. FORTH will provide funds to purchase/lease the electric vehicles and cover the cost to install electric charging stations for vehicles used by Northside Senior Center and City Seniors Center. Through the use of electric vehicles, Senior St. Louisans who rely on services from contracting organizations will have access to transportation that will assist in providing meals and transportation for daily errands and appointments.

The ordinance does not require the construction of parking beyond what is required by the Zoning Code. Physical requirements for an EV ready location consist of the following: an adequately sized electrical service supply, conduit and conductor from the electric service panel to a termination point and branch circuit capacity for a 208/240V 50A dual pole circuit breaker. In the scenario where EVSE is to be installed per the respective parking requirements, a list is provided for the required number of Level II ‘chargers” to be installed in conjunction with the requirement for the number of spaces to EV ready for future expansion.
This bill will empower the City of St. Louis to prepare for the future of electric vehicles and the growing demand for electric vehicle charging as the electric vehicle fleet increases. Numerous positive benefits are an outcome of transportation electrification, such as reduced air pollution and carbon emissions, workforce development for electricians and reduced operating costs over the lifetime of the vehicle.

Covid-19 Response Grant for Board of Elections
This Board Bill authorizes the Board of Elections to accept the Center for Tech and Civic Life (the “CTCL”) Covid-19 Response Grant of $1,034,200.00 to provide financial assistance to local election officials (“LEOs”) for expenses incurred between June 15, 2020 and December 31, 2020, associated with the safe administration of election responsibilities, including safe election day administration; poll worker recruitment, training and safety efforts; voter education and outreach for safe voting policies and procedures; and expanding and maintaining early in-person voting sites and expedited and improved vote-by-mail ballot processing.
The grant limits reimbursement to expenses incurred between June 15 and December 31, 2020, in accordance with an assessment called “Safe Voting Plan” prepared by the STL BEC. The grant precludes supplanting previously appropriated funds to BEC or the reduction in budgeted funds to the BEC during the term of this grant unless CTCL grant funds are to be returned.

Closing the St. Louis City Medium Security Institution (MSI)
This Board Bill, in accordance with Article XXV Section 1 of the St. Louis City Charter, and upon being recommended by the Board of Estimate and Apportionment, amend the duties of the Division of Corrections and Department of Health & Hospitals. It would direct the Commissioner of Corrections to begin the process of closing the St. Louis City Medium Security Institution (MSI), also known as the Workhouse, as a detainee center.
This Board Bill would direct the Board of Public Service and the Commissioner of Corrections to evaluate the City Justice Center to determine if more detainees could safely be held there and to perform a study of the Medium Security Institution to determine the feasibility of repurposing and to evaluate the ongoing costs of any plan to permanently close the facility. It would direct the Commissioner of Corrections to contact surrounding facilities to determine the per day cost of outsourcing the housing detainees in St. Louis City custody; a requirement for the Department of Personnel to interview corrections officers of the workhouse for open positions in city government. It requires the Department of Health to develop criteria for the hiring of social workers to be assigned to detainees with mental health issues and their families, and to be employees of a newly formed Division of Recidivism Reduction.
This board Bill would create a fund to be allocated to neighborhoods with high violent crime rates to be appropriated annually through neighborhood participatory budgeting process; upholding the City’s statutory requirement to detain individuals remanded to the City of St. Louis through the court system. It would direct the Criminal Justice Coordinating Council to provide data as requested by the Board of Aldermen or any department or division of City Government facilitating the closure of the Medium Security Institution facility. It would also direct the Budget Director to analyze the net cost savings to the general fund if MSI is no longer operated as a detainee facility; and it contains an emergency clause.

Expansion of the Port Authority District Boundaries
Overall Purpose/Reasons for the Board Bill
The City of St. Louis Port Authority port district boundaries currently include approximately 6,000 acres, primarily along the City’s 19-mile riverfront. Every other port district in Missouri is coterminous with the boundaries of the city or county (or counties) that created the port district. Examples include Kansas City, St. Louis County and Jefferson County. Expanding the boundaries of the City of St. Louis Port Authority as proposed by Board Bill Number 28 will allow the City of St. Louis Port Authority to qualify for additional federal and state grant programs and to participate in development and infrastructure projects throughout the expanded boundaries, as described below.
What the Board Bill Will Do
Expand the boundaries of the City of St. Louis Port Authority as shown on the map attached as Exhibit A to Board Bill Number 28.
The Impact of the Board Bill to the Community
Over the last 10 years, the City of St. Louis Port Authority has received approximately $1 million from the Port Security Grant Program administered by the Federal Emergency Management Agency for video surveillance along the riverfront and to supplement technology at the Real Time Crime Center. A larger port district will enable the Port Authority to qualify for additional federal and state grant programs, including but not limited to the Port Security Grant Program, for City-wide safety and security enhancements and other eligible purposes.
In 2016, the Missouri General Assembly authorized port authorities to create Advanced Industrial Manufacturing (AIM) zones. Within an AIM zone, a port authority may receive one-half of State withholding taxes attributable to new jobs within the zone. A larger port district will enable the Port Authority to leverage these state funds for a wide range of infrastructure and other development purposes within the AIM zone.
In 2010, the Missouri General Assembly authorized port authorities, with the approval of the Missouri Highways and Transportation Commission and the circuit court, to create Port Improvement Districts upon request of property owners within the boundaries of any proposed district. Similar to a transportation development district or a community improvement district, the qualified voters within a Port Improvement District may elect to impose a sales tax and/or a property tax to fund qualified costs within the boundaries of the Port Improvement District. A larger port district will enable the City of St. Louis Port Authority to make this job-creation program available in more parts of the City.

Police Escort for Building Demolitions
The proposed bill would amend Section 1 of ordinance 63800 codified in Chapter 25.64.010 of the City’s code to charge of $150.00 to cover the cost to the City for providing police security escort services during Building Division demolitions, repairs, board-ups, and clean-ups of buildings or structures that have been declared public nuisances. It allows for a police security escort to be provided when, under the circumstances, such precaution is deemed prudent by the Building Commissioner and will help to reduce vacancy by increasing the holding costs of vacant buildings by enabling the City to recoup some of the cost of dealing with them.

Building Energy Performance Standard (BEPS)
A. The overall purpose and/or reasons for the bill.
The purpose of the Building Energy Performance Standard (BEPS) bill is to reduce greenhouse gas emissions, drive energy efficiency improvements in its buildings, and boost its economic growth and job creation within the City of St Louis. This bill builds upon the Energy Awareness Ordinance passed in 2017, which requires buildings that are 50,000 square feet and above to report energy and water data annually to the City. The BEPS aligns with the City’s climate goals and its Pathways to 100% Clean Energy report which recommends a BEPS. Pursuing this policy also aligns with the City’s goals in making significant carbon reductions and providing leadership to other cities throughout the American Cities Climate Challenge.
B. What the bill will do.
St. Louis’ BEPS will require large commercial, multi-family, institutional, and municipal buildings (50,000 sq. ft. and above) to reduce energy use in order to meet an energy performance standard by May 2025, which will be reviewed and updated every four years. Performance standards will be set by the Building Energy Improvement Board and measured in the amount of energy used per square foot at the building (site energy use intensity or EUI) and based on building type. Building owners will be required to comply with standards using a free, online ENERGY STAR Portfolio Manager tool. This bill will include the creation of a new Office of Building Performance to oversee the implementation, compliance and enforcement of the existing Building Energy Awareness ordinance (#70474), BEPS, and any future ordinances related to building energy improvement and performance.
C. The main components of the bill and significant provisions. The bill creates a Building Energy Improvement Board with representation from the building industry, utilities, and building owners. The board’s role is three-fold: to oversee a rulemaking process that sets and updates performance standards; to advise, to oversee implementation of the ordinance; and to administer a process for creating alternative compliance methods for buildings unable to meet the required standards.
D. The impact the bill will have to the community
Passage of this bill will have a positive impact on both economic growth and environmental impact. The Building Division – working with the Board, local utilities, and other partners – will provide as many resources as possible to assist building owners with compliance, including educational opportunities, continued one-on-one assistance with benchmarking, and financial and other resources.

Overall Purpose/Reasons for the Board Bill
This Board Bill will facilitate real and personal property tax abatement and sales and use tax exemption incentives in connection with a project at Anheuser Busch’s Soulard brewery complex. The project will accommodate new products from existing brewing material streams, further building on the Company’s global sustainability initiatives.
What the Board Bill Will Do
This Board Bill will authorize an industrial revenue bond transaction that will facilitate the following incentives:
• 5 years of 50% real property tax abatement;
• 5 years of 75% personal property tax abatement; and
• Sales and use tax exemption on the purchase of construction materials used on real property improvements
The industrial revenues bonds will be purchased by the Company and will be payable only from lease revenues paid by the Company, and not from any City tax revenues. The City approved similarly-structured industrial revenue bond transactions for the Company in 2018 (Ordinance No. 70921), for Huvepharma in 2017 (Ordinance No. 70590), and for Square, Inc. in 2015 (Ordinance No. 70132).
The Main Components of the Board Bill
The Board Bill (1) approves a Plan for an Industrial Development Project, which is attached as Exhibit A to the Board Bill, as is required by Chapter 100, RSMo. for this type of incentive, and (2) authorizes the issuance of the industrial revenue bonds to facilitate the above-described incentives.
The Impact of the Board Bill to the Community
The Board Bill will incentivize the Company to invest approximately $100 million in the City and enhance its St. Louis operations. A Cost/Benefit Analysis describing the financial impacts of the tax incentives on the various taxing districts is included in Exhibit A to the Board Bill and will be sent to each of the taxing districts, as required by Chapter 100, RSMo.

An ordinance approving a Redevelopment Plan for the 3434 and 3436 Indiana Ave. ("Area") after finding that the Area is blighted as defined in Section 99.320 of the Revised Statutes of Missouri, 2000, as amended, (the "Statute" being Sections 99.300 to 99.715 inclusive), containing a description of the boundaries of said Area in the City of St. Louis ("City"), attached hereto and incorporated herein as Attachment "A", finding that redevelopment and rehabilitation of the Area is in the interest of the public health, safety, morals and general welfare of the people of the City; approving the Plan dated January 23, 2018 for the Area ("Plan"), incorporated herein by attached Attachment "B", pursuant to Section 99.430; finding that there is a feasible financial plan for the development of the Area which affords maximum opportunity for development of the Area by private enterprise; finding that no property in the Area may be acquired by the Land Clearance for Redevelopment Authority of the City of St. Louis ("LCRA") through the exercise of eminent domain; finding that the property within the Area is unoccupied, but if it should become occupied the Redeveloper shall be responsible for relocating any eligible occupants displaced as a result of implementation of the Plan; finding that financial aid may be necessary to enable the Area to be redeveloped in accordance with the Plan; finding that there shall be available 10-year tax abatement (5-year 100% tax abatement followed by 5-year tax abatement based on 50% of the assessed value of the incremental improvements); and pledging cooperation of the Board of Aldermen and requesting various officials, departments, boards and agencies of the City to cooperate and to exercise their respective powers in a manner consistent with the Plan.
