File a Disability Discrimination Grievance with the Board of Election Commissioners

Overview
Title II of the Americans with Disabilities Act requires state and local governments to ensure that people with disabilities have a full and equal opportunity to vote. The ADA’s provisions apply to all aspects of voting, including voter registration, site selection, and the casting of ballots, whether on Election Day or during an absentee voting process. If you feel that you have not been able to access your right to vote because of accessibility issues, or because you have been discriminated against based on your disability, follow the instructions below to file a complaint with the Board of Elections.
Preparation
A complaint can be filed orally or in writing. Alternative means of filing complaints, such as personal interviews or a tape recording of the complaint, will be made available for persons with disabilities upon request.
When making your complaint orally or in writing, please be thorough and specific. Outline exactly what occurred, where it occurred, and list the names of witnesses or election officials who were present.
In Writing
If you are at your polling place, please let the Election Judge at the Poll know that you would like an ADA Complaint Form.

Orally
If you are at your polling place and are unable to fill out the complaint form, election board staff can take your complaint orally and fill out the form on your behalf.
Instructions
Submit your complaint as soon as possible after the alleged violation, preferably within 30 calendar days, to either Leo G. (Gary) Stoff, Jr., Republican Director of Elections, or D. Benjamin Borgmeyer, Democratic Director of Elections.

What to Expect
Within 15 calendar days after receipt of the complaint, the ADA Coordinators will meet with you to discuss the complaint and a possible resolution. Within 15 calendar days of that meeting, the ADA Coordinators will respond in writing or in a format that is accessible to you, such as large print, Braille, or audio tape. The response will explain the position of the Election Board and offer options to resolve the complaint.
The ADA Coordinators will maintain the files and records of the Election Board relating to complaints.
If the response by the ADA Coordinators does not satisfactorily resolve the issue, you may appeal the decision within 15 calendar days after the receipt of the ADA Coordinators’ determination. The Chairperson of the Election Board will consider your appeal.
Within 15 calendar days after receipt of the appeal, the Chairperson or his/her designee will respond in writing or in a format that is accessible to you with a final resolution of the complaint.
