An ordinance repealing paragraph (f) of Section Two of Ordinance 63780, approved on May 31, 1996, as amended in Ordinance 64550, approved January 15, 1999, and Ordinance 68236 approved January 16, 2009 and in lieu thereof a new paragraph (f) is enacted extending the period of time during which the Central West End Southeast Special Business District shall be permitted to collect a tax within the boundaries of the district and increasing the amount of such tax to an amount not to exceed $0.85 per $100.00 of assessed valuation of all real property within such district and to amend and restate the use for which the additional revenue produced by such tax may be put to include cleaning, landscaping and maintenance, security and public safety, purchase and installation of public infrastructure, public transportation, administration, and contingency fund for such categories; and containing effectiveness and emergency clauses.

An ordinance authorizing and directing the Mayor and the Comptroller of the City of Saint Louis to execute a permanent, irrevocable Easement, which shall give, grant, extend and confer on the City of Saint Louis, its agents, successors, and assigns, the exclusive right to build and maintain a span of sidewalk improvements along the east side of Sulphur Ave. from the intersection of Sulphur Ave. and Manchester Ave. to the driveway to the north; and containing a severability clause.

Stat., as amended (“Buyer”), necessary for the sale by St. Louis to Buyer of certain surplus property (the “Property”) located in St. Louis County that is more fully described in Section 1 and EXHIBIT “A” of the Agreement and Contract of Sale in accordance with and subject to its provisions and to the applicable rules and regulations of the Federal Aviation Administration (“FAA”) and the applicable provisions of the Airport’s Amended and Restated Indenture of Trust between UMB Bank, N.A., Trustee dated October 15, 1984 as amended, and restated on September 10, 1997 as amended; providing for the deposit of the proceeds from the Agreement and Contract of Sale; authorizing and directing the Mayor and the Comptroller of St. Louis to enter into and execute on behalf of St. Louis the “Quit Claim Deed” substantially in the form as set out in EXHIBIT “B” to the Agreement and Contract of Sale subject to and in accordance with the terms of the Agreement and Contract of Sale, remising, releasing and forever quit-claiming unto the Buyer, its successors and assigns the Property subject to the easement and restrictive covenants as defined and provided for in the Quit Claim Deed; conditioning the execution and delivery by St. Louis of the agreements, documents, and instruments contemplated in this Ordinance on the FAA’s prior written approval of: a) the release and sale of the surplus Property to the Buyer, b) the provisions of the Agreement and Contract of Sale including, without limitation, the “Purchase Price” of Two Million One Hundred Twenty Thousand Five Hundred Dollars ($2,120,500.00), as defined and provided for in Section 2 of the Agreement and Contract of Sale, and c) any other related matter required to be submitted to and approved by the FAA; authorizing the Mayor, the Comptroller, the Register, the City Counselor, Director of Airports, and other appropriate officers, officials, agents, and employees of St. Louis with the advice of the Director of Airports to enter into and execute on behalf of St. Louis and in St. Louis’ best interest any attendant or related documents, agreements, affidavits, certificates, or instruments deemed necessary to effectuate the terms set forth in the Agreement and Contract of Sale or the Quit Claim Deed, and/or deemed necessary to preserve and protect St. Louis’ interest and to take such actions as are necessary or appropriate in connection with the sale of the Property or the consummation of the transactions contemplated herein; providing that the provisions set forth in this Ordinance shall be applicable exclusively to the agreements, documents, and instruments approved and/or authorized by this Ordinance, and containing a severability clause, and an emergency clause.

BOARD BILL NO. 170 INTRODUCED BY TERRY KENNEDY An ordinance prohibiting the issuance of any package liquor license for any non-licensed premises within the boundaries of the Eighteenth Ward Liquor Control District, as established herein, for a period of three years from the effective date hereof; containing exceptions and allowing, during the moratorium period, for the transfer of existing licenses, under certain circumstances; and containing an emergency clause.

BOARD BILL # 128 INTRODUCED BY ALDERWOMAN APRIL FORD-GRIFFIN An ordinance recommended by the Port Authority Commission of the City of St. Louis authorizing and directing the Mayor and the Comptroller to enter into a lease agreement between the City of St. Louis and Steel Warehouse Company LLC, for certain land on the Unimproved Wharf for a period of ten (10) years commencing on the date of execution with three (3) five (5) year options, in substantially the form attached hereto and incorporated by reference herein as Exhibit 1, and containing an emergency clause.

(a California corporation), d/b/a AT&T Internet Services ("the Company") pursuant to which Company will access and use City property, as defined in the Agreement, to construct and operate a wireless broadband internet access system for public use and to provide free and fee wireless broadband internet access, on terms and conditions set forth in the Agreement, a form of which is attached hereto, marked Exhibit 1 and incorporated herein by reference.

An ordinance recommended by the Airport Commission, the Board of Public Service, and the Board of Estimate and Apportionment authorizing and directing the Director of Airports and the Comptroller of the City of St. Louis, Missouri, a municipal corporation ("St. Louis") to enter into and execute on behalf of St. Louis an “Agreement and Contract of Sale” (substantially in the form as set out in ATTACHMENT “1” which is incorporated herein), between St. Louis, the owner and operator of Lambert–St. Louis International Airport® (“Airport”) which is located in St. Louis County, Missouri, and the City of Kinloch, Missouri, a municipal corporation (“Buyer”), necessary for the sale by St. Louis to Buyer of certain surplus property (the “Property”) located in St. Louis County that is more fully described in Section 1 and EXHIBIT A of the Agreement and Contract of Sale in accordance with and subject to its provisions and to the applicable rules and regulations of the Federal Aviation Administration (“FAA”) and the applicable provisions of the Airport’s Amended and Restated Indenture of Trust dated October 15, 1984 and amended and restated on September 10, 1997 (as amended, “Airport Indentures”); providing for the deposit of the proceeds from the Agreement and Contract of Sale; authorizing and directing the Mayor and the Comptroller of St. Louis to enter into and execute on behalf of St. Louis the “Quit Claim Deed” substantially in the form as set out in EXHIBIT C to the Agreement and Contract of Sale subject to and in accordance with the terms of the Agreement and Contract of Sale, remising, releasing and forever quit-claiming unto the Buyer, its successors and assigns the Property subject to the easement and restrictive covenants as defined and provided for in the Quit Claim Deed; conditioning the execution and delivery by St. Louis of the agreements, documents, and instruments contemplated in this Ordinance on the FAA’s prior written approval of: a) the release and sale of the surplus Property to the Buyer, b) the provisions of the Agreement and Contract of Sale including, without limitation, the “Purchase Price” of Three Hundred Fifty Four Thousand Dollars ($354,000) as defined and provided for in Section 2 of the Agreement and Contract of Sale, c) Buyer’s development plan for the surplus Property, and d) any other related matter required to be submitted to and approved by the FAA; authorizing the Mayor, the Comptroller, the Register, the City Counselor, and other appropriate officers, officials, agents, and employees of St. Louis with the advice of the Director of Airports to enter into and execute on behalf of St. Louis and in St. Louis’ best interest any attendant or related documents, agreements, affidavits, certificates, or instruments deemed necessary to effectuate the terms set forth in the Agreement and Contract of Sale or the Quit Claim Deed, and/or deemed necessary to preserve and protect St. Louis’ interest and to take such actions as are necessary or appropriate in connection with the sale of the Property or the consummation of the transactions contemplated herein; providing that the provisions set forth in this Ordinance shall be applicable exclusively to the agreements, documents, and instruments approved and/or authorized by this Ordinance, and containing a severability clause, and an emergency clause.

An ordinance repealing Ordinance 50038 and enacting a new ordinance pertaining to prohibiting installing, possessing or operating in any motor vehicle in the City of St. Louis any device for the producing or reproducing of sound at any time with louder volume than is necessary for convenient, normal hearing for the persons who are in the vehicle in which the device is being operated and who are voluntary listeners: further prohibiting the operating of any device for the producing or reproducing of sound at any time with louder volume than is necessary for convenient, normal hearing for the persons who are in the room in which the device is being operated and who are voluntary listeners; containing penalty provisions, including fines; seizure and impoundment of vehicles for evidence; and containing an emergency clause.

An ordinance pertaining to noise; repealing Paragraph (7) of Section One of Ordinance 41720, approved on January 4, 1940, and codified as Section 15.50.080 of the Revised Code, and enacting in lieu thereof a new ordinance prohibiting construction, demolition and excavating within one thousand (1,000) feet of a residential property, including excavation, demolition, alteration or repair of any building, land clearing, land grading or road and utility construction within one thousand (1,000) feet of a residential property before 6:00 a.m. and after 11:00 p.m., Monday through Friday, and before 6:00 a.m. and after 12 Midnight, Saturday and Sunday, except in case of an urgent necessity in the interest of public safety; containing definitions and an emergency clause.

An ordinance approving the Development Plan for the CORTEX West Redevelopment Area submitted by the CORTEX West Redevelopment Corporation (hereinafter referred to as the “Development”); confirming the finding that the area is a blighted area which should be redeveloped in the public interest; finding that said Development Plan is in the public interest and conforms to the general plan for the City; granting a certificate of public convenience and necessity to said Developer to exercise the power of eminent domain; providing for tax abatement; authorizing the Mayor to enter into an agreement on behalf of the City of St. Louis with the Developer; setting forth the terms and conditions of said agreement; incorporating by reference Chapter 353, Revised Statutes of Missouri, 2000, as amended and Chapter 11.06 of the Revised Code of the City of St. Louis, as amended; and containing a severability clause.

An ordinance pertaining to graffiti; prohibiting any person from placing graffiti upon any public or private property within the City of St. Louis; making it unlawful for any person to maintain graffiti that has been placed upon, or allow graffiti to remain upon, any surface within that person's control, possession or ownership when the graffiti is visible from a public street, public alley, other public right-of-way and other public property; declaring that graffiti is a public nuisance; further establishing a procedure for removal of graffiti from private property under the direction of the Forestry Commissioner; containing definitions, a penalty clause and an emergency clause.

An Ordinance recommended and approved by the Board of Estimate and Apportionment authorizing and directing the Director of Airports and the Comptroller for the City of St. Louis (the "City") to enter into and execute on behalf of the City an Airport Use and Lease Agreement with a term ending June 30, 2011 (the "Use Agreement") and, when indicated, an Airport Use and Lease Agreement Cargo Addendum (the “Cargo Addendum”) for Lambert- St. Louis International Airport® (the "Airport") between the City and executed by any airline operator (the “Airline”) listed in ATTACHMENT A to this Ordinance, which is attached hereto and incorporated herein, granting to such Airline certain rights and privileges for the use of the Airport and its facilities subject to the terms, covenants, and conditions set forth in the Use Agreement and the Cargo Addendum that were approved by the City’s Airport Commission and the City’s Board of Estimate and Apportionment, and are attached hereto as ATTACHMENT B and ATTACHMENT C respectively to this Ordinance and made a part hereof; containing a severability clause; and containing an emergency clause.
